O plenário do Tribunal de Contas da União (TCU) recomendou nesta quarta-feira (23) que o Ministério de Minas e Energia (MME) e a Agência Nacional de Energia Elétrica (Aneel) estudem alternativas à caducidade da concessão da Enel São Paulo antes de uma eventual decisão pela extinção do contrato. A recomendação determina que sejam avaliados os efeitos da medida para os consumidores e para o sistema de distribuição de energia. O processo foi relatado pelo ministro Augusto Nardes. Análise dos impactos O TCU determinou que governo e Aneel façam uma “análise estruturada” antes de uma eventual caducidade. O estudo deverá considerar quais operadores poderiam assumir a concessão, o cronograma de transição, o custo de indenização dos bens reversíveis, o possível impacto nas tarifas e os riscos para o setor de distribuição. Segundo o tribunal, deverá ser demonstrado, de forma fundamentada, que a caducidade produziria benefício líquido ao consumidor. Processo na Aneel A recomendação ocorre enquanto a Aneel analisa o processo que pode resultar na recomendação de caducidade da concessão da Enel São Paulo. A diretoria da agência ainda decidirá se recomenda ou não a medida ao Ministério de Minas e Energia. A palavra final caberá ao governo federal. A Enel contesta a conclusão da Aneel de que sua distribuidora paulista apresenta “falhas estruturais” na prestação dos serviços. A avaliação considera, entre outros fatores, o desempenho da empresa na recuperação do fornecimento após eventos climáticos extremos registrados em 2023, 2024 e 2025. Argumentos da Enel A recomendação do TCU está alinhada a um pedido apresentado pela própria Enel nas alegações finais do processo. Histórico inédito A eventual caducidade da Enel São Paulo seria inédita no setor elétrico brasileiro. A medida nunca foi aplicada a uma concessão de distribuição de energia no país. Em casos anteriores, houve situações em que o poder público assumiu os serviços ou em que o operador decidiu vender a concessão. Uma eventual mudança no comando da Enel exigiria medidas para garantir a continuidade do fornecimento. Prazo de 60 dias O TCU também determinou que governo e Aneel apresentem, em até 60 dias, um cronograma detalhado das ações previstas para garantir a continuidade da distribuição de energia em São Paulo após o término do atual contrato da Enel, previsto para 2028. O documento deverá indicar as medidas planejadas para a transição e para a manutenção do serviço. Renovação em suspenso A Enel havia pedido a renovação antecipada da concessão paulista, mas o processo está suspenso até a conclusão do procedimento de caducidade. A decisão sobre o futuro da concessão dependerá das próximas etapas na Aneel e no Ministério de Minas e Energia, enquanto o TCU acompanha os possíveis impactos de uma eventual mudança de operador. Origem do processo A atuação do TCU começou em 2023, após representação do Ministério Público junto ao tribunal. O processo foi aberto para analisar as causas de um apagão ocorrido na área de concessão da Enel, na Grande São Paulo, e acompanhar as medidas adotadas pelo governo federal.
