Foi sancionada nesta quarta-feira (23) lei que institui protocolo de atendimento a mulheres, crianças e pessoas vítimas de violência física e sexual. Entre outros pontos, o protocolo determina que o primeiro atendimento à vítima de violência seja realizado por um profissional de segurança pública e que este deve garantir o encaminhamento imediato da vítima à unidade pública de saúde, assim como realizar o registro da ocorrência. O chamado Protocolo Intersetorial de Atendimento e Resposta Integrada em Situações de Violência, destinado a orientar a atuação das autoridades em casos de violências física e sexual contra mulheres, crianças, adolescentes e pessoas em situação de vulnerabilidade.  A lei também determina realização de perícia por perito não oficial nomeado pela autoridade competente nas localidades em que não houver órgão de perícia oficial de natureza criminal. Em relação aos profissionais de saúde e de segurança pública, o treinamento “específico e periódico” visa garantir atendimento baseado na não revitimização. A Lei n° 15.516, de 22 de setembro de 2026 altera outra normativa, a Lei nº 12.845 de 1º de agosto de 2013, chamada de Lei do Minuto Seguinte e que assegurava às vítimas de violência sexual o atendimento imediato pelo Sistema Único de Saúde (SUS). Entre as medidas já previstas estavam amparos médico, psicológico e social, exames preventivos e informações sobre direitos e a obrigatoriedade de notificação a autoridade competente, no prazo de 24 horas, dos casos em que houver indícios ou confirmação de violência sexual, para as providências cabíveis e para fins estatísticos.  Entre outros pontos, o protocolo estabelecido pela nova legislação determina: Atendimento médico imediato para avaliação do estado clínico e emocional; Informação à vítima sobre os seus direitos, incluindo o direito de acesso a atendimento médico e psicológico especializados, bem como a assistência social; Preservação, pelos profissionais de saúde, dos materiais e vestígios que possam ser coletados no exame médico-legal, e encaminhamento do material coletado ao órgão de perícia oficial de natureza criminal; Deslocamento do perito até a vítima, caso esta estiver impossibilitada de comparecer para a realização do exame de corpo de delito; As unidades policiais ou de saúde onde for realizado atendimento a vítimas de violência deverão contar com salas reservadas, destinadas ao acolhimento e atendimento multidisciplinar. Além disso, a lei determina que a a conclusão e encaminhamento do laudo pericial à autoridade policial devem ser feitos no prazo máximo de dez dias corridos. Outro ponto de destaque determina que as autoridades precisarão adotar todas as medidas necessárias para a preservação do local do crime e das provas materiais que possam contribuir para a investigação. O Conselho Tutelar deverá ser comunicado, no caso de a vítima ser criança ou adolescente, e poderá, autorizar e adotar os procedimentos necessários, com base no Estatuto da Criança e do Adolescente (ECA), a Lei nº 8.069, de 13 de julho de 1990. Nos casos de descumprimento do protocolo, que resultem em revitimização ou prejuízo à investigação ou à proteção da vítima, a autoridade poderá configurar o crime de violência institucional, nos termos da Lei de Abuso de Autoridade (Lei nº 13.869, de 5 de setembro de 2019), sem prejuízo das demais sanções.
